Farmhouse42.com, the operator of the website vitalitywand.mx, establishes these Terms and Conditions to govern the use of the site and all transactions conducted through it. By accessing the site or placing an order on vitalitywand.mx, you agree to be bound by these terms, in compliance with the Federal Consumer Protection Law (Ley Federal de Protección al Consumidor – LFPC), the Commercial Code, and other applicable regulations in Mexico.
1. Acceptance of Terms
Use of the website or placement of an order constitutes full and unconditional acceptance of these Terms and Conditions. If you do not agree, please refrain from using the site.
2. Formation of Contract
A binding sales contract is formed only upon receipt of an order confirmation email. We reserve the right to reject or cancel orders in cases of pricing errors, product unavailability, suspected fraud, or breach of these terms.
3. Prices and Payments
All prices are displayed in Mexican Pesos (MXN) and include applicable VAT (IVA) or US Dollar (USD). The price in effect at the time of order confirmation applies. We reserve the right to correct typographical errors or price inaccuracies due to currency fluctuations, taxes, or unforeseen costs. Accepted payment methods are indicated during checkout and processed through Stripe a secure third-party provider. We do not store full credit card details.
4. Shipping and Delivery
Shipments are made throughout Mexico via reliable courier services. Estimated delivery times are provided on the site and depend on location; we are not responsible for delays caused by the carrier or force majeure events. Shipping costs are calculated at checkout and borne by the customer, except in cases of explicit promotions.
5. Cancellation and Returns
In accordance with the LFPC, you have the right to cancel your purchase without penalty within 5 business days following receipt of the product, provided it has not been used and remains in its original intact packaging. For hygiene reasons, returns of intimate products are not accepted once the sealed packaging has been opened. To exercise this right, contact our support team prior to returning the product. Return shipping costs are the customer’s responsibility, unless the product is defective or incorrect. Refunds will be processed using the original payment method within 10 business days of receiving the product in acceptable condition.
6. Warranty
All products come with a legal warranty against manufacturing defects, in accordance with the LFPC. You may request repair, replacement, refund, or price reduction, depending on the circumstances, assuming the claim is justified. Damage caused by misuse, improper handling, modifications, or abuse is not covered. Please contact support before returning items under warranty.
7. Complaints and Claims
Complaints regarding defects must be notified within a reasonable time after discovery. We encourage detailed descriptions of issues to facilitate resolution. For any claims, contact our support channels. We aim to resolve issues promptly and in line with consumer protection regulations.
8. Limitation of Liability
We are not liable for indirect damages or losses. Our liability is limited to the purchase price of the product.
9. Intellectual Property
All content on the site, including text, images, and logos, is property of Farmhouse42.com or its licensors and protected by applicable laws.
10. Governing Law
These terms are governed by the laws of Mexico. Any disputes will be resolved in accordance with applicable regulations, with PROFECO available for mediation.
